Terms of Service

Welcome to Pickup. By using the app, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the app.

1. Overview

Pickup is a mobile application that helps parents and guardians coordinate child pickups within trusted circles of family and friends. The app facilitates communication and coordination — it does not provide transportation services.

2. Eligibility

You must be at least 18 years old to create an account and use Pickup. By using the app, you represent that you are at least 18 years old and have the legal capacity to agree to these Terms.

Pickup is a coordination tool, not a transportation service. We do not employ drivers, verify driving records, or guarantee the safety of any pickup. You are solely responsible for:

6. Subscriptions and Payments

Pickup offers free and paid subscription tiers (Plus and Pro). Subscriptions are billed through Apple's App Store or Google Play and are subject to their respective terms. You can manage or cancel your subscription at any time through your device's subscription settings.

7. Community Posts and Messaging

You may post Offers and Feelers in your circles and send messages to other members. You are responsible for the content you post. We reserve the right to remove content that violates these Terms.

8. User Content License

By posting content on Pickup — including messages, photos, community posts (Offers and Feelers), and children's information — you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, use, display, reproduce, and distribute your content solely for the purpose of operating, improving, and promoting the service.

This license exists only so we can deliver the service to you and your circle members (e.g., displaying your post to other circle members, storing your children's information so drivers can see it during a pickup). This license ends when you delete your content or your account, except for content that has already been shared with other users or that exists in aggregate, de-identified form.

You retain ownership of all content you post. You represent that you have the right to share any content you upload and that it does not violate any third party's rights.

9. Intellectual Property

The Pickup app, its design, features, and original content are owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the app. User-generated content remains the property of the user who created it, subject to the license granted in Section 8.

You may delete your account at any time through the app. We may suspend or terminate your account if you violate these Terms or if we reasonably believe your use of the service poses a risk to other users. Upon termination, your data will be deleted in accordance with our Privacy Policy.

12. Disclaimer of Warranties

The app is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the app will be uninterrupted, error-free, secure, or meet your specific requirements.

13. Limitation of Liability

To the maximum extent permitted by law, Pickup and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of or inability to use the service.

14. Dispute Resolution and Arbitration

Please read this section carefully — it affects your legal rights.

You and Pickup agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of the service will be resolved through binding individual arbitration rather than in court, except that either party may bring claims in small claims court if they qualify.

No class actions: You and Pickup agree that disputes will be resolved on an individual basis only. Neither party may participate in a class action, class-wide arbitration, or any other representative proceeding.

Arbitration rules: Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in the Commonwealth of Kentucky or, at your election, may be conducted by phone or video conference.

Opt-out right: You may opt out of this arbitration agreement by sending written notice to support@pickupapp.ai within 30 days of creating your account. Your notice must include your name, email address, and a clear statement that you wish to opt out of arbitration. If you opt out, disputes will be resolved in the courts of the Commonwealth of Kentucky.

15. Changes to These Terms

We may update these Terms from time to time. Continued use of the app after changes constitutes acceptance of the updated Terms. We will notify you of significant changes through the app or by email. For material changes to the arbitration clause, we will provide at least 30 days' notice.

16. Governing Law

These Terms are governed by the laws of the Commonwealth of Kentucky, United States, without regard to conflict of law principles.
